We will outline the principles of the Islamic State and its course of action. As a result, a clear draft of the Islamic constitution will come before us. In this part of the book we think it is logical to first discuss the origins of the constitutional law of Islam, so that the basis of all subsequent discussions may come before us.
If it becomes clear at the outset about the Islamic State that its source is the Qur'an and Sunnah, not the experience of other states, then there can be no misunderstanding. The main ideological misconception of the current ruling class of Muslim states and the so-called modernists is that they speak of the Islamic State, but refer to the Western nations as the source.
We can certainly benefit from the experience of others, but it lies within the limits of our own system and keeps its vitality intact. That is why we will first of all highlight the source of the constitutional law and the difficulties in the way of its application. Another reason for this discussion is the need to deny the hadith.
A group is engaged in a mischievous attempt to create intellectual skepticism about Hadith. They object to the hadith being a source of law and evidence. There is a limitless need to critique this point of view and to provide accurate and realistic explanations of the situation. The truth is that no clear outline of the Islamic state system can be made without Hadith.
In this chapter the necessary parts of the various essays of the author have been compiled and those are indicated in the notes.
The source of constitutional law in Islam
The state which establishes the sovereignty of Allah and the Khilafah Ala Minhajin in the manner of prophethood with all the features of its system of governance is called Islamic State. Today, wherever efforts are being made in the world to establish such a state and determine its type and course of action, it is necessary to turn to a few special sources. These are the activities of Rashid in the caliphate of the Qur'an and the Sunnah of the Prophet (peace be upon him) and the decision of the mujtahid scholars of the ummah.
The source of the unwritten state constitution of Islam is these four and by studying these one can know the type and characteristics of the Islamic state and the relevant principles and clauses of the Islamic constitution can be deduced from it. Quran Majeed The first and greatest source of Islamic constitution is Quran Majeed. In Islamic terminology, Kitab means the Book which was sent down by Allah Ta'ala to His Messengers to guide mankind.
In this sense, the book is the official statement of the message or the divine word according to Islamic terminology which is conveyed to the people by the Prophet to analyze its interpretation and to make it a reality. The permanent rule of Allah is that the purpose of teaching the people through the Prophet (peace and blessings of Allah be upon him) is to reveal to the heart of the Prophet (peace and blessings of Allah be upon him) the principles and fundamentals.
None of its language and meaning possesses the Prophet's own intellect and thought, the point of his will and aspiration. That is why it is the word of God in both words and meaning, not the Prophet's own composition. The Prophet, as a faithful messenger, conveys this message to the servants of Allah. Moreover, he explained the meaning and significance of the book with the help of God's foresight. On the basis of these divine principles, the Prophet built a complete structure of morality, sociality and civilization and culture.
He brought about a radical change in people's thinking, inclinations and thinking through education, good advice and his own virtuous character. He instilled in them the notions of piety, purity, purity and good conduct. Through education and practical guidance he unites them in such a way that a new society emerges with new mentality, new thinking and meditative ideas, new customs and new laws.
Moreover, he left among them the Book of Allah, as well as his teachings, initiations and signs of good character, which always serve as a beacon of guidance for the society and the next generation.
